Does the photovoltaic system generate less electricity than agreed? Owners don’t have to accept that. Why you should be picky when it comes to acceptance.
If the photovoltaic system is delivered defectively or late, those affected may be entitled to compensation. This is shown by a ruling by the Bielefeld Regional Court (ref.: 5 O 149/22), to which the legal portal “anwaltauskunft.de” refers. Last but not least, buyers should be picky when it comes to acceptance and may refuse to accept it if the work is not done cleanly.
In this case, the plaintiff had ordered two photovoltaic systems that had several defects. On the one hand, they were only connected after the agreed time, and on the other hand, they then did not provide the agreed service.
The plaintiff suffered financial damage because she was able to use less electricity or feed it into the grid. She called on the company carrying out the work to remedy the defects and pay compensation.
Company must eliminate deficiencies – and more
The court completely agreed with the woman. The company was ordered to rectify the deficiencies identified and must also bear the costs of the appraisal and compensate the woman for her lost profits.
By the way: The fact that the woman refused to accept the work was a good thing for her. The company carrying out the work had to prove that the system was installed without defects – which they were unable to do.
